Can you sell second hand digital copies of music files?

A company called Redigi insist that you can, and are in court now fighting their case. They argue that their software checks whether a music file has been downloaded from a legitimate source (eg iTunes) and then deletes the file from the sellers PC once a sale has been made. However, it seems to be done via copying the file from the user to the ‘shop’ which is where the ciopyright infringement kicks in. Capitol Records have taken this to court in the US and will be interesting to see what the verdict is…
